Terms of Service

These terms are an agreement between you and the company operating Maidaname, for whoever creates an account and uses the product to run a naming project. If you were invited to weigh in on someone else's project and never made an account yourself, a shorter section further down covers what applies to you; you're not asked to accept these terms yourself; the account holder who invited you is the one bound by them. What we do with your name and email if you're in that position is covered in the Privacy Policy (Work #40), not repeated here.

By creating an account, you're stating that you're old enough, wherever you are, to enter into an agreement like this one, and that you're using the product for yourself or with authority to use it on behalf of a business you represent. Nothing in the product currently checks either of those things at sign-up; this is a representation you're making to us when you create an account, not a claim that we verify it.

You need an account to create or own a project. An account is one name, one email, and either a password or Google sign-in; whichever you use, you're responsible for keeping access to it secure, and for what happens under it. One account owns a project, and there's no shared or joint ownership of a project between two accounts.

You can take part in a naming round, answer questions, and give your reaction to candidate names, without creating an account or accepting these terms. The account holder running that project invited you and is responsible for that invitation. Your involvement is limited to the round you were invited to; you never get broader access to the product, and the access code you were given only opens that round.

Maidaname helps you generate and evaluate candidate names, using AI models, and helps you check a candidate against a domain registry and a small set of reference and dictionary sources. What a check establishes is limited, and the product says so directly wherever it shows you a result: a finding is evidence, and decides nothing on its own. A record existing, or none being found, is not clearance. No legal or trademark clearance is performed for any name, by this product, anywhere. Before you commit to a name, whether for a product, a company, or anything else, that's a decision to check with a lawyer, not something this product does for you.

Using the product to generate or evaluate names costs money, tracked as a balance in your account. A new account starts with an empty balance; there's currently no free trial. You fill your balance in $10 increments, paid by card through Stripe; we never see or store your card number, only Stripe's confirmation that a payment went through. Your balance is spent as you use AI generation and evaluation; when it runs out, processing stops and nothing else does; everything you've already made stays exactly where it is, readable and editable, and you can keep working by hand without spending anything further. Filling your balance again lets AI processing resume.

If you ask within 30 days of the purchase, we'll refund any unused balance, minus Stripe's processing and currency-conversion fees, which aren't refunded to us either. Once balance has been spent, we only refund it if the AI processing itself failed, such as erroring, timing out, or being charged twice for the same action, never because you didn't want the result it produced; any such refund is at our discretion and may be reduced by our own cost of having attempted that processing.

Use the product for what it's for: naming things, with people you've invited to help. Don't use it to abuse, harass, or impersonate anyone; don't try to break the access-code system that protects a round; don't use the product to generate or store anything unlawful. We reserve the right to limit, suspend, or end access to an account that violates these terms.

You own the projects you create and the material you write into them. Names an AI model generates for your project are yours to use, subject to the terms of the AI provider whose model produced them; we route between several providers depending on the request.

The product is provided as it is, without a promise that it will be available without interruption or free of errors. Nothing it produces, generated names, evaluations, or the results of a domain or reference check, is legal, trademark, or business advice, and none of it is a substitute for checking with a professional before you commit to a name.

To the extent the law where you are allows it, the company isn't liable for indirect, incidental, or consequential damages arising from your use of the product, and its total liability for any claim is limited to what you paid in the twelve months before the claim arose.

We can suspend or end your access to the product if you violate these terms, and you can stop using the product and close your account at any time by contacting us. Closing an account currently requires first removing any projects it owns; see the Privacy Policy's account-deletion note (Work #40) for why, since it's the same underlying gap.

We may update these terms as the product changes. If we make a change that materially affects your rights, we'll tell you about it, not just edit the page and leave you to notice.

This depends on the operating entity and its country, still undecided per decision 1.4, the same open item that blocks a jurisdiction statement in the Privacy Policy.
